General terms and conditions

These terms govern the online booking of food tours and, where expressly stated on the relevant product page, of additional activities sold through Tapas Experience.

1. Details of the provider

The website and the booking service of Tapas Experience are operated by:

Company name: HIGH LEVEL INSIDE, S.L.

Tax ID (NIF): B05301007

Registered address: Avenida de la Filosofía, 30, 41927 Mairena del Aljarafe, Seville, Spain

Email: info@tapasexperience.com

2. Purpose and scope

These terms govern the contractual relationship between Tapas Experience and anyone booking food tours, set menus or experiences combining dining with additional services through the website.

Each product page describes the specific content of the experience: city, venues, tapas, drinks, additional activities, estimated duration, price, number of participants and any specific conditions. In the event of any conflict, the particular conditions shown on the product page and during the booking process shall prevail, provided they are more specific and were accepted before payment.

3. The user and capacity to contract

The user declares that they have sufficient legal capacity to enter into a contract and that the information provided is complete, truthful, accurate and up to date. If booking on behalf of other people, the user declares that they are authorised to share their details and to accept the conditions applicable to the experience.

4. Information provided before booking

Before completing the booking, the user may review the essential features of the experience, its total price, applicable taxes, the date and time selected, the number of participants, the services included, availability, the conditions for changes or cancellation, and the accepted payment methods.

The user is responsible for checking these details before confirming payment. The information published does not replace the safety, accessibility, allergen or operational instructions that each venue may provide.

5. Booking process

Bookings are made through the following steps:

1. Select the tour or experience.

2. Choose the date, time and number of participants, where applicable.

3. Enter your contact details and any notes needed to manage the booking.

4. Review the summary, the total price and the applicable conditions.

5. Choose a payment method and expressly accept these terms.

6. Confirm payment and receive the booking by email.

The contract is deemed to be formed once the user receives the booking confirmation. If payment is authorised but no confirmation is received, please contact Tapas Experience before making a second purchase. You can do so through the contact form on the website or by writing to info@tapasexperience.com.

6. Prices, taxes and expenses

Prices are shown in euros and include applicable taxes, unless expressly stated otherwise. The total amount payable and any applicable surcharge will be shown before the booking is confirmed.

Any services, drinks, transfers or personal expenses not expressly listed as included are at the user's own cost. Where the price is shown per person, the total will depend on the number of participants selected.

7. Payment methods and security

Payment is processed through the providers enabled at any given time. Tapas Experience does not store full card details where these are handled by the payment gateway.

8. Booking confirmation and proof

Confirmation will be sent to the email address given by the user and will include, as a minimum, the booking number or reference and the essential details of the experience. The user must check the information and report any error without delay.

The booking may be presented in digital format. The booking holder may be asked to show identification where this is needed to locate or verify the purchase.

9. Availability

All bookings are subject to availability. Selecting a date or time does not secure a place until the process has been completed and confirmation has been issued.

If an experience cannot be provided after being confirmed for reasons attributable to Tapas Experience or to a partner, an equivalent alternative, a change of date or a refund of the amounts corresponding to the service not provided will be offered, as appropriate.

10. How the tours run

Tours run in line with the venues, times and services stated on the product page and in the confirmation. The published duration is an estimate and may be affected by the pace of the group, traffic, how busy venues are, service times or causes beyond the control of Tapas Experience.

Unless stated otherwise, travel between venues is on foot and transport is not included. The user must arrive on time at the first venue or meeting point and follow the order and times communicated.

11. Services included and excluded

The booking includes only the tapas, drinks, admissions or activities expressly described on the product page. It does not include additional drinks, transfers, personal expenses or any other service not mentioned.

Photographs of dishes and venues are for illustration only. The exact composition may vary due to product availability, season or operational needs, keeping as far as possible to the category and value of the experience booked.

12. Partner venues and activities

Tapas Experience coordinates experiences provided in whole or in part by partner venues and operators. Each partner is responsible for correctly providing the service it delivers, without prejudice to the rights the user holds against Tapas Experience as the contracting or selling party.

Where justified, a venue, dish, drink, route or time may be replaced by an alternative of equivalent characteristics and value. If the change substantially affects the experience, the user will be informed and offered the options available by law.

13. Punctuality and no-shows

The user must arrive with the advance notice stated in the confirmation. Arriving late may reduce the time available at a venue, alter the route or prevent part of the experience from being provided where time slots have been reserved.

14. Changes requested by the user

Requests to change the date, time, number of participants or booking details are subject to availability and to the particular conditions of the product. A request is not accepted until written confirmation is received.

If participants cannot be added to a confirmed booking, separate bookings may be made for the same date and time. Being seated at the same table or placed in the same group is not guaranteed.

15. Cancellations and refunds

The applicable cancellation conditions will be shown before payment and in the booking confirmation. Refunds, where due, will be made using the same method used for payment, unless this is technically impossible or another arrangement is agreed.

16. Right of withdrawal

Under consumer law, the right of withdrawal may not apply to catering services or leisure activities where the contract provides for a specific date or period of performance. This exception applies only where its legal requirements are met and it was disclosed before booking.

Outside those cases, the legally applicable withdrawal regime will apply. This is independent of any commercial policy on changes and cancellations that Tapas Experience may offer.

17. Cancellation or changes by Tapas Experience

Tapas Experience may cancel or modify an experience due to unforeseen lack of availability, closure of a venue, weather conditions, operational incidents, safety reasons, force majeure or other justified causes.

Where an experience cannot be provided, the user will be informed as soon as possible and offered a reasonable alternative, a change of date or a refund of the affected service. Indirect expenses not booked through Tapas Experience will not be refunded, unless required by law.

18. Allergies, intolerances and dietary preferences

The user must report any relevant allergy, intolerance or dietary requirement when booking. Doing so does not mean that every experience can be adapted, nor does it remove the risk of traces or cross-contamination.

Before booking, people with severe allergies must confirm that the venues included can meet their needs. Tapas Experience will pass on the necessary information to partners where required to manage the booking.

19. Accessibility

Tours may involve walking and venues with differing accessibility features. The user should report their needs and questions before booking in order to receive information about the experience selected.

20. Rules of conduct

Participants must show respect for staff and other customers, and observe the schedule, the venues' rules and safety instructions. Tapas Experience or the partner may prevent or stop the participation of anyone behaving in a dangerous or offensive way, or in a way incompatible with the normal running of the experience, without prejudice to any rights available by law.

21. Liability

Tapas Experience is liable for the obligations corresponding to it under the contract and applicable law. It is not liable for breaches attributable to the user, for incorrect information provided during booking, or for unavoidable events beyond its control, without prejudice to the non-waivable rights of consumers and users.

Nothing in these terms limits liability that cannot be excluded by law.

22. Customer service and complaints

The user may request assistance, report incidents or submit complaints through the Tapas Experience contact channels, quoting the booking reference and providing the information needed to look into the case.

23. Data protection

Personal data is processed in accordance with the privacy policy published on the website. Managing a booking may require certain data to be shared with venues, payment providers or the operators delivering the experience.

Data relating to allergies or health needs should only be requested and shared where necessary to manage the experience, applying the appropriate safeguards.

24. Intellectual property

The content, texts, photographs, logos, designs and elements of the website are protected by intellectual and industrial property law. Accessing them grants no rights of reproduction, distribution, adaptation or exploitation beyond the personal use needed to book and enjoy the services.

25. Electronic communications

The user agrees to receive by email the communications needed to manage the booking, including confirmations, changes, reminders and incidents. Marketing communications are governed by the preferences and consents given by the user.

26. Changes to these terms

Tapas Experience may update these terms for legal, technical, operational or commercial reasons. The version applicable to a booking is the one accepted at the time of contracting, save for later changes that are more favourable or required by law.

27. Keeping a copy of the contract

The user may save these terms before booking and will receive confirmation of the booking on a durable medium. Tapas Experience will keep the contractual information for the periods required by law.

28. Governing law and dispute resolution

These terms are governed by Spanish law. Where the user is a consumer, any dispute will be submitted to the courts having jurisdiction under consumer protection law, without requiring the user to waive their legal venue.

29. Entire agreement and severability

If any clause is declared void or unenforceable, it will cease to have effect only to the extent necessary, and the remaining provisions will stay in force. Failure to exercise a right does not amount to waiving it.
